Overview

Welcome to cortē. These Terms of Service ("Terms") govern your use of our website at cortepadelco.com.au and the purchase of products from cortē padel co. ("cortē", "we", "us", "our").

By accessing or using our website and services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

Our store is powered by Shopify. Shopify enables us to provide our services to you, but your purchase contract is with cortē, not Shopify.

Section 1 — Eligibility

By using our services, you confirm that you are at least 18 years of age, or that you are using the services with the supervision and consent of a parent or legal guardian. You represent that all information you provide is accurate, current, and complete.

Section 2 — Products

We have made reasonable efforts to display our products accurately, including colours and descriptions. However, we cannot guarantee that your device's display will accurately reproduce product colours. Product images are representative only.

We reserve the right to modify, discontinue, or limit quantities of any product at any time without notice.

Section 3 — Orders and pricing

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm it by email. We reserve the right to decline or cancel any order for any reason, including pricing errors or suspected fraud. If we cancel your order, you will receive a full refund.

All prices are displayed in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. Prices do not include shipping, which is calculated at checkout.

Prices are subject to change without notice. The price charged will be the price displayed at the time of your order, as confirmed in your order confirmation email.

Section 4 — Payment

We accept payment via the methods listed at checkout. By providing payment information, you confirm that you are authorised to use the payment method provided.

Payment is processed securely by Shopify Payments or our nominated payment provider. cortē does not store full card numbers or sensitive payment credentials.

Section 5 — Shipping and delivery

Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs, or events outside our reasonable control.

Risk of loss and title for products passes to you upon delivery to the carrier. If your order is lost in transit, please contact us and we will work with you to resolve the matter.

Section 6 — Returns and refunds

Our Refund and Returns Policy, available at cortepadelco.com.au/policies/refund-policy, forms part of these Terms and is incorporated by reference.

Nothing in these Terms or our Returns Policy limits or excludes any rights you have under the Australian Consumer Law, including guarantees that goods are of acceptable quality, fit for purpose, and match their description.

Section 7 — Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired, refunded or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy you have under the Australian Consumer Law. To the extent that any provision of these Terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law prevails.

Section 8 — Intellectual property

All content on our website and social media, including but not limited to our name, logo, product names (the Barossa, the Daintree, the Noosa, the Portsea), brand assets, photography, copy, and design, is owned by or licensed to cortē and protected by Australian and international intellectual property law.

You may not reproduce, distribute, modify, or use any of our intellectual property without our prior written consent. Personal, non-commercial use of our website content is permitted for the purpose of viewing and shopping only.

Section 9 — User conduct

You agree to use our website and services lawfully and in good faith. You must not:

  • Use our website for any unlawful, fraudulent, or harmful purpose

  • Infringe the intellectual property rights of cortē or any third party

  • Transmit malicious code, spam, or unsolicited communications

  • Attempt to gain unauthorised access to any part of our website or systems

  • Use automated tools, bots, or scrapers to access our website without our written consent

  • Misrepresent your identity or affiliation with any person or organisation

Section 10 — Third-party links and services

Our website may contain links to third-party websites or services. These are provided for your convenience only. We do not control, endorse, or take responsibility for the content or privacy practices of any third-party sites. You access them at your own risk.

Section 11 — Limitation of liability

To the maximum extent permitted by law, cortē's liability to you for any claim arising from your use of our website or purchase of our products is limited to the amount you paid for the relevant product.

We are not liable for any indirect, incidental, consequential, or special loss or damage, including loss of profits, data, or opportunity, arising from your use of our website or services.

Nothing in this section excludes or limits any liability that cannot be excluded or limited under the Australian Consumer Law or any other applicable Australian law.

Section 12 — Disclaimer of warranties

Our website and its content are provided "as is." To the extent permitted by law, we make no warranties, express or implied, regarding the website's availability, accuracy, or fitness for a particular purpose.

Your statutory rights under the Australian Consumer Law are not affected by this disclaimer.

Section 13 — Indemnification

You agree to indemnify and hold harmless cortē, its officers, directors, employees, and agents from any claims, losses, damages, or costs (including legal fees) arising from your breach of these Terms, your misuse of our website, or your violation of any applicable law or third-party rights.

Section 14 — Privacy

Our collection and use of your personal information is governed by our Privacy Policy, available at cortepadelco.com.au/policies/privacy-policy, which forms part of these Terms.

Section 15 — Feedback and reviews

If you submit reviews, comments, or feedback to us, you grant cortē a non-exclusive, royalty-free, perpetual licence to use, reproduce, and display that content in connection with our business. You confirm that any feedback you provide is your own and does not infringe the rights of any third party.

Section 16 — Governing law and jurisdiction

These Terms are governed by the laws of Queensland, Australia, and the applicable laws of the Commonwealth of Australia, including the Australian Consumer Law.

You and cortē submit to the non-exclusive jurisdiction of the courts of Queensland, Australia. This does not limit any rights you may have under the Australian Consumer Law to pursue remedies in other jurisdictions.

Section 17 — Changes to these Terms

We may update these Terms from time to time. The most current version will always be available at cortepadelco.com.au. Continued use of our website after changes are posted constitutes acceptance of the updated Terms. We will notify you of material changes by email or via a notice on our website where required by law.

Section 18 — Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

Section 19 — Entire agreement

These Terms, together with our Privacy Policy and Refund and Returns Policy, constitute the entire agreement between you and cortē with respect to your use of our services and supersede any prior agreements or understandings.

Section 20 — Shopify relationship

Our store is powered by Shopify. Shopify enables us to provide our services to you but is not a party to your purchase contract with cortē. Any sales and purchases you make are made directly with cortē. Shopify is not responsible for any aspect of those transactions.
